
Is a settlement agreement considered a contract?
I sued this company several years back, and we settled the case. We also signed a settlement agreement. If a party violated the settlement agreement, can the be sued for breach of contract?
If a settlement agreement is violated, then the injured party typically has two options for recourse. He can either sue to enforce the terms of the agreement, which is a ‘breach of contract’ case, or he can seek to have the settlement agreement voided, and proceed on the original claim.
The “several years back” comment in your post might make the second option a non-starter, though – SoL may have expired.
